1. Use of the App

The App is designed to provide micro-learning (nanolearning) content, including videos, for Home Health care professionals and administrators. You may use the App only for lawful purposes and in accordance with these Terms.

Eligibility

You must be at least 18 years old and authorized by your organization (if applicable) to use the App. By using the App, you represent that you meet these requirements.

2. Medical Professional Accountability

The App provides educational content and tools to support Home Health care professionals. However:

• Your Responsibility: If you are a medical professional, you are solely accountable for your actions, decisions, and care provided to patients. You must adhere to all applicable official medical best practices, standards, and guidelines (including those from relevant professional bodies, such as the American Medical Association or Centers for Medicare & Medicaid Services). The App does not replace professional judgment or physician oversight.
• Physician Orders: Where applicable, you must follow all orders prescribed by a licensed physician. The App's content is not a substitute for such orders or medical advice.
• No Medical Advice: The App is an educational resource, not a provider of medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider for patient-specific guidance.
• Disclaimer of Malpractice Liability: We are not responsible or liable for any malpractice, errors in professional judgment, patient outcomes, or other consequences arising from your use or application of the App's content. You agree to indemnify and hold us harmless from any claims related to your professional conduct.

3. Account and Data

Account Creation: To use the App, you must provide accurate first and last names, company name, and email address. You are responsible for maintaining the confidentiality of your account credentials.

Data Use: We collect and use your data only for authentication and authorization, as outlined in our Privacy Policy.

4. Prohibited Conduct

You agree not to:

• Use the App for any illegal or unauthorized purpose.
• Share, reproduce, or distribute App content without our prior written consent.
• Download, copy, record, or otherwise capture any nanolearning videos or other content from the App for reuse, redistribution, reselling, or any commercial purpose outside of your authorized use within the App.
• Attempt to reverse-engineer, hack, or interfere with the App's functionality.

5. Intellectual Property

All content, features, and designs in the App, including nanolearning videos, are owned by PulsePath or our licensors and are protected by copyright, trademark, and other laws. You are granted a limited, non-exclusive, non-transferable license to use the App for its intended purpose only. This license does not permit downloading, copying, modification, or any form of reuse or resale of the content, including for training purposes outside the App. Any unauthorized use may result in immediate termination of access and legal action to protect our intellectual property.

6. Termination

We may suspend or terminate your access to the App at our discretion, with or without notice, if you violate these Terms or for any other reason. You may also discontinue using the App at any time by deleting your account.

7. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the App will be error-free, uninterrupted, or suitable for your specific needs.

8. Limitation of Liability

To the fullest extent permitted by law, PulsePath is not liable for any indirect, incidental, or consequential damages arising from your use of the App, including but not limited to errors in content or loss of data. This includes, without limitation, any liability for malpractice, patient harm, or professional misconduct.

9. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we will notify you through the App or by email. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
